Privacy Notice – Ludium Music Waitlist

1. Introduction Welcome to Ludium Music! This Privacy Notice explains how Gabriel Lam ("I", "me", "my"), as the individual developing the Ludium Music initiative, collects, uses, and protects your personal data when you sign up for the Ludium Music waitlist. I am committed to protecting your privacy and complying with UK data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.   

Once Ludium Music is formally established as a legal entity (e.g., Ludium Music Ltd.), this Privacy Notice will be updated to reflect the company as the data controller.

3. What Personal Data Do I Collect? When you sign up for the Ludium Music waitlist, I collect the following personal data:

  • Your first name

  • Your last name

  • Your email address

4. How I Collect Your Data I collect this data directly from you when you provide it to sign up for the waitlist, for example, at a networking event or via any future online sign-up form I may make available.

5. Lawful Basis for Processing Your Data The lawful basis for processing your personal data for the purposes described in this Privacy Notice is your consent. You provide this consent when you agree to my Waitlist Terms and Conditions and this Privacy Notice upon signing up. You can withdraw your consent at any time.

6. How I Use Your Personal Data I use your personal data to:

  • Send you email updates about the development and progress of Ludium Music.

  • Notify you about the potential launch of Ludium Music products or services.

  • Share news and general information related to Ludium Music's mission to support musician well-being.

  • Occasionally, I might invite you to participate in surveys or provide feedback (this will always be optional).

  • Manage the waitlist and my communications with you.

I will not use your personal data for any other purposes without notifying you and obtaining your consent where necessary.

7. Data Sharing and Disclosure I will not sell, rent, or trade your personal data with third parties for their marketing purposes. I may share your data with third-party service providers who help me operate the waitlist and send email communications (e.g., an email marketing platform or cloud storage provider like Wix for website/email infrastructure). Where I use such providers, I will ensure they are subject to appropriate data protection obligations.

I may also disclose your personal data if required to do so by law or in response to valid requests by public authorities.

8. Data Storage and Security Your personal data is stored securely. I use Wix’s infrastructure for email management. I take reasonable technical and organisational measures to protect your personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure, or access.

9. International Data Transfers Some service providers I may use (e.g., for cloud storage or email services like Wix) may process data outside the UK or European Economic Area (EEA). Where this is the case, I will ensure that appropriate safeguards are in place to protect your personal data, such as by relying on approved contractual clauses or ensuring the provider is certified under a relevant adequacy scheme recognized by the UK.

10. Data Retention I will retain your personal data for as long as is necessary for the purposes of managing the waitlist and keeping you informed about Ludium Music. This means I will keep your data:

  • Until Ludium Music launches and we transition to a different communication method (at which point you'll be informed and your choices respected), OR

  • Until you request to be removed from the waitlist (withdraw your consent), OR

  • For a maximum period of 24 months from the date you signed up if the project's status has not significantly changed, whichever occurs first.

If Ludium Music does not proceed to launch, I will securely delete your personal data collected for this waitlist within 12 months of the decision not to proceed, or within 24 months of your sign-up if no decision has been made by then.

11. Your Data Protection Rights Under UK GDPR, you have the following rights regarding your personal data:

  • Right of access: You can ask for a copy of the personal data I hold about you.

  • Right to rectification: You can ask me to correct any inaccurate personal data.

  • Right to erasure (or "right to be forgotten"): You can ask me to delete your personal data in certain circumstances.

  • Right to restrict processing: You can ask me to restrict the processing of your personal data in certain circumstances.

  • Right to data portability: You can ask for your data to be provided in a portable format in certain circumstances.

  • Right to object: You can object to the processing of your personal data, particularly for direct marketing.

  • Right to withdraw consent: You can withdraw your consent at any time by clicking the "unsubscribe" link in my emails or by contacting me directly. Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal.

12. Cookies If I launch a website for Ludium Music, it may use cookies. A separate Cookie Policy will be provided on the website to explain their use. This waitlist sign-up process (especially if conducted offline or via a very simple initial online form) may not involve cookies directly attributable to Ludium Music at this stage.

13. Changes to This Privacy Notice I may update this Privacy Notice from time to time to reflect changes in my practices or for legal reasons. If I make significant changes, I will notify you via the email address you provided. The "Last Updated" date at the top of this Notice will indicate the latest revision.
